KC Conde Investigations

Basic Rules:

 

CLIENT Interference / Misrepresentation – KC Conde Investigations reserves the right to terminate an investigation at any time if there is CLIENT interference or misrepresentation by CLIENT or second or third parties directed by CLIENT. Should this agreement be terminated due to CLIENT interference and/or misrepresentation, CLIENT will forfeit the entire retainer for the contract.

 

Accuracy of Information – The accuracy of information submitted by the CLIENT will directly determine the success of the provided investigative services. KC Conde Investigations cannot be held liable for inaccuracies in public record information, databases accessed, or requests submitted by the CLIENT. While the information furnished by the KC Conde Investigations is from reliable sources, its accuracy is not guaranteed.

 

All information provided by the KC Conde Investigations should be verified regarding the accuracy, timeliness, and legal applications before preparing reports or using information. Information provided may have incomplete, incorrect, omitted, misspelled, or deleted items. The accuracy of the information supplied is not in the control of the KC Conde Investigations. KC Conde Investigations shall attempt to maintain the integrity of all information and data provided. Information and data collected during this investigation shall be released to the CLIENT or other party intended as per the request of the CLIENT, at the sole discretion of the KC Conde Investigations.

 

No Warranties or Guarantee – Neither the KC Conde Investigations nor its agents have made any warranties nor guarantees as to the success or outcome of the investigation, research, or matters involved in the investigative services to be provided for the CLIENT. CLIENT understands that investigations are limited by time and resources and may not produce the final product that the CLIENT had desired or intended.

 

Indemnification of KC Conde Investigations from CLIENT Provided Information – The CLIENT agrees to indemnify and hold the KC Conde Investigations, and agents harmless against all claims, damages, losses, expenses, liabilities, and/or CLIENT or third-party actions arising out of or related to any information which the CLIENT provided to the KC Conde Investigations before or during the conduct of services provided. KC Conde Investigations, and agents shall not be liable for any legal, financial, incidental, or consequential damages of any type.

 

Refunds – Based on the nature of investigative work, we are unable to guarantee the desired result for the CLIENT. Therefore, we do not issue refunds for our services rendered. However, in the event there are unused retainer funds after all investigative services have been completed, the KC Conde Investigations shall refund all unused retainer funds within thirty days of completion of the investigation.

 

Termination of Agreement – This Agreement shall remain in effect until all retainer funds have been exhausted or until all services are completed as agreed. Either party may terminate this agreement with 48 hours' written notification. If CLIENT terminates this agreement early for any reason, all scheduled work shall be billed at 50% (fifty percent). This agreement can be extended upon the acceptance and receipt of additional retainer funds at the discretion of the KC Conde Investigations.

 

Restraining / Protective Orders – KC Conde Investigations will not conduct any investigative services or obtain any information for a CLIENT who has a restraining or protection order placed on them. Suppose such an order is in place, and the CLIENT has not disclosed this information to the KC Conde Investigations. In that case, this agreement will be terminated upon discovery of this information by the KC Conde Investigations, and the CLIENT shall forfeit the full retainer.
